REGISTRATION REQUIREMENTS
We will not approve any registrations of bidders who are California, Illinois, or New York residents; No residents from States with Foid cards.  Also, registrations are not permitted for those located outside the USA. A photo ID will be required to pick up all purchases.

REQUIREMENTS for Firearm Purchases: Lot# 251 to Lot# 428.
1. All firearms FFL paperwork will be processed ONLY from the assigned FFL dealer, Guns and Gears.

2. The FFL fee is $20 per gun. This will apply to all firearm purchases.

3. FOR IN-PERSON FIREARM PICKUP: Purchaser of a firearm/s must have a scheduled appointment.
a. Purchaser Must pay for purchases no later than WEDNESDAY, JULY 17, 2024, by 2:00 pm.
b. The firearm pickup location will be at the FFL dealers’ location, Guns and Gears, LaPorte City, IA. It will NOT be at the Hilpipre Auction Co. facility.
c. NOTE: It could take 2 weeks before pickup dates are scheduled.
d. Driver’s License will need to be presented at pickup time.

4. Purchasers who will require shipping of firearm purchase/s:
a. FOR FIREARM SHIPMENTS: NO firearms to be shipped to an individual. Firearm purchases will only be shipped to an FFL dealer. It is the purchaser’s responsibility to communicate with their FFL dealer. They must be fully aware and willing to accept your firearm purchase/s. Purchaser must email the FFL dealer’s certificate to Guns and Gear, Josh Lansink, email: joshlansink@gmail.com

b. After the payment is completed, the Auction Company will inform FFL dealer Josh Lansink. He will contact the purchaser to make shipping arrangements.

c. Purchaser to pay the actual the shipping fees.

5. Guns and Gears will process the paperwork, prepare the firearms for pickup or shipment.

6. REMINDER: No firearm purchaser will be allowed to “pickup” their purchased firearms at time of payment, must schedule an appointment. Guns and Gears will only ship firearms to another FFL Dealer.

ALL Purchasers. Please email us no later than one hour after receiving your invoice on the auction day to specify if payment will be made remotely or in person. All buyers must make payment before scheduling a pickup appointment.

PAYMENT: US FUNDS ONLY –Wire Transfer, Cashier check (for remote payment, must be mailed by overnight carrier), or Credit Card with an additional 4% fee, OR Cash (In-person payment only), NO CHECKS!!!

Additional terms for credit card charges: There is a NO CHARGEBACK PROVISION. The bidder / Buyer agrees he/she will not initiate a chargeback under any circumstances, waiving such rights that may exist under the agreement between the bidder/buyer and credit card companies. The buyer/bidder further agrees should a chargeback be initiated, the bidder/buyer's terms and conditions will be conclusive evidence of the bidder’s waiver. If a chargeback is successful, the buyer remains liable for the purchase price plus the cost of collection, including attorneys’ fees.

TERMS & CONDITIONS OF SALE
1. The Auctioneer will announce whether the auction is with or without reserve. All rights of the auctioneer and the purchaser shall be in force depending on the type of auction. Announcements made during the sale supersede any previous, spoken, or printed announcements. Any persons selling or consigning items to the sale shall not bid on said items or is not allowed to have an associate or agent bid for them.

2. Any person desiring to procure any bids shall register with the Auction Co. Registering will consist of providing all necessary information requested by the Auction Co. All persons registering guarantee that the provided information is accurate and warrant that they are authorized to bid on behalf of the firm or party represented. Auctioneers or Auction Co. reserve the right to refuse any applicant a bidding card and may revoke such privilege at any time.

3. All purchases must be settled in full on the day of the sale and removed from the premises within the time specified by the auctioneer. Payment shall be in cash, cashier checks, or credit cards, with an additional fee or checks. Checks must be accompanied by a bank letter of credit guaranteeing the check. Auctioneers or Auction Co. will have the sole right to determine if a person does not need to provide a letter of credit or if payment may be delayed. By bidding on items in the auction, the buyer represents to auctioneers that he is financially solvent and that all checks issued by the buyer will be honored. A dishonored check proves the buyer is insolvent and entitles the auctioneer to remedies available under applicable laws.

4. All goods will be divided into lots and sold to the highest bidder for cash. When questions arise regarding the price for which lots have been sold, the record kept by the clerk of sale and the marked catalog of the Auctioneer shall, in all cases, be accepted by the buyers as final.

5. Auctioneers reserve the sole right to change the sale order, the lots' size, and the addition or subtraction of a lot number. They will also have the sole right to determine the bidding increment. In the event of a buyers’ dispute or tie bid, the Auctioneer has the sole right to either open up the bidding for continued advancement or strike the goods sold. Auctioneers reserve the right to refuse any bid they consider an insignificant advance over the preceding bid.

6. Any errors in accounting regarding the purchaser's bill will be corrected according to the facts. The purchaser agrees to pay what is owed. The purchaser shall not be entitled to possession of any of his purchases until the total purchase price of all his items has been paid in full. In the event the purchaser fails to pay the total purchase price of any lot within the prescribed time or fails to compile with any terms of sale, Auctioneers shall have retained a possessory lien on all lots of the purchaser and, at their sole discretion, have the right to resell such lots by public or private sale without notice of any kind to purchaser.

7. Any printed literature given to purchasers, such as a buyer's catalog, shall only be a guide. If Auctioneers express an opinion on condition or merchantability and what price should be paid, no sale shall be invalidated because of any defect or inaccuracy in any of the lots because they are inaccurately described in this listing catalog or elsewhere; no liability shall be borne by the Auctioneer regarding any such faults or errors.

8. Purchaser acknowledges and agrees that all goods have been available before sale time and that he is purchasing all goods with all defects. DO NOT BID UNLESS YOU HAVE DETERMINED THE CONDITION OF THE LOT FROM YOUR EXAMINATION. Buyer acknowledges sole responsibility and assumes the risk that a lot after it has been inspected might change. The auctioneer will sell the lot(s) as it exists at the time sold, as is, where is, with no warranties, whether implied or expressed. Any warranties or guarantees will be between the buyer and seller only.

8. The auction sale site shall include any location where a lot is located for display and/or removal. The actual bid calling could be at the auction site or at a designated location the auctioneer decides. Auction sales sites are considered potentially dangerous places, and immediately upon registration, if not before, the purchaser shall notify agents, servants, employees, and others accompanying him.

9. All claims or disputes must be settled on the day of the sale at the sale site. No claims will be allowed after the removal of goods.

10. Appropriate taxes will apply. Tax exemptions are accepted if the purchaser produces proper documentation of their exemptions.

REMOVAL TERMS
1. The Purchaser will be responsible for completely removing all goods purchased. The cost of removal will be the responsibility of the purchaser.

2. Auctioneer reserves the right to require proof of adequate insurance coverage from any buyer of lots requiring dismantling, rigging, or hot cutting.

3. Any damage caused to real property or other goods caused by the purchaser or his agents, the purchaser agrees to cover all damage to the property and legal expenses. Purchaser agrees to indemnify and hold harmless the Auction Co., Auctioneers, their agents, and all sellers from and against any damage to property or injury to person or loss of life occasioned directly by the act or acts of the buyer or buyer’s representative, agent, or employees in connection with the dismantling or removal of any lot or any other action resulting from the attendance of the purchaser to this sale.

4. If the purchaser fails to remove any such lot or part thereof within the designated period, the Auctioneer or his designated person shall have the right. They shall be under no obligation to do so either in the name of the Auctioneer or other seller or the purchaser to remove, store, abandon, discard, sell, or otherwise dispose of each of any part of the lot bid in or purchased at the expense and risk of the purchaser without waiving any other rights that the auctioneer or other seller may have against the purchaser.

5. The purchaser shall continue to be liable for all loss, expense, and damage directly sustained by the auctioneer or seller due to the purchaser's failure to comply with the preceding condition.

FOR the Hunting Accessories – Lot# 429 to 704; All purchasers MUST pick up purchases in person. There will be NO SHIPPING.
The purchaser is FULLY responsible for arranging their pickup, packaging, and removal.


The buyer assumes all risk of loss at the time the item is sold. The relationship between the Auction Co. and the buyer is not a bailment. All Merchandise is sold as is, where is, and no warranties are in effect!

Remove all items per the directed removal dates.

A photo ID will be required to pick up purchases.

Thurs., JULY 18: 9:00 am to 4:00 pm

FINAL DAY: Sat., JULY 20 by 2:00 pm

REQUIREMENTS for Firearm Purchases: Lot# 251 to Lot# 428.
  1. All firearms FFL paperwork will be processed ONLY from the assigned FFL dealer, Guns and Gears.
  2. The FFL fee is $20 per gun. This will apply to all firearm purchases.
  3. FOR IN-PERSON FIREARM PICKUP: Purchaser of a firearm/s must have a scheduled appointment
    1. Purchaser Must pay for purchases no later than WEDNESDAY, JULY 17, 2024, by 2:00 pm.
    2. The firearm pickup location will be at the FFL dealers’ location, Guns and Gears, LaPorte City, IA. It will NOT be at the Hilpipre Auction Co. facility.
    3. NOTE: It could take 2 weeks before pickup dates are scheduled.
    4. Driver’s License will need to be presented at the time of pickup.
 
  1. Purchasers who will require shipping of firearm purchase/s:
    1. FOR FIREARM SHIPMENTS: NO firearms to be shipped to an individual. Firearm purchases will only be shipped to an FFL dealer. It is the purchaser’s responsibility to communicate with their FFL dealer. They must be fully aware and willing to accept your firearm purchase/s. Purchaser must email the FFL dealer’s certificate to Guns and Gear, Josh Lansink, email: joshlansink@gmail.com
    2. After completing the payment made, The Auction Company will inform FFL dealer Josh Lansink. He will contact purchaser to make shipping arrangements.
    3. Purchaser to pay the actual the shipping fees.
  2. Guns and Gears will process the paperwork, prepare the firearms for pickup or shipment.
  3. REMINDER: No firearm purchaser will be allowed to “pickup” their purchased firearms at time of payment, must schedule an appointment. Guns and Gears will only ship firearms to another FFL Dealer.
